Nuts &
bolts of credit restoration:
We have proprietary software in use at our operations center
that processes disputes with the three
major national credit bureaus according
to the Fair Credit reporting Act of
1970.
Our program has the capability of processing initial credit reports,
dispute letters, demand letters, money
back letters & USID (unknown subscriber
ID) letters
automatically.
Letters generated are filled with a generous portion of content
reflecting consumer feelings on the
subject matter as well as with pertinent
content required to provide adequate
substance for the basis of each dispute.
We think our new enhanced system is
proving to be the best automated system
in the credit repair industry today. To
aid the potential client in choosing to
ask us to help or to undertake this
their selves, you might add that the
time required for the average person to
write a multitude of letters along with
associated logistics could run into a
couple of hundred hours, plus manual
record keeping procedures do not often
produce follow-up demand-type letters on
a timely basis after the 30-day bureau
response period runs out, whereas our
system does continue.
If after any reinvestigation of any information disputed by
us on behalf of the customer, an item of
the information is found to
be inaccurate or incomplete or cannot be
verified, the credit reporting agency by
law is required to promptly delete that
item of information from the consumer’s
file or modify that item of information
as appropriate. If the agency fails to
do so then we will challenge the agency
on your behalf.
If an
item of information is deleted from a
customer’s credit file because it was
found to be inaccurate or incomplete or
cannot be verified, the consumer is
still responsible for any debt that can
be verified with the creditor involved.
If any information is deleted from a
consumer’s file pursuant to the FCRA,
the information may not be reinserted in
the file by the reporting agency unless
the creditor involved certifies that the
information is complete and accurate.
Also, the reporting agency shall notify
the consumer of the reinsertion.
Notification shall be in writing not
later than 5 business days after the
reinsertion.
No one
can legally remove accurate and timely
negative information from a credit
report that was placed according to the
Fair Credit Reporting Act of 1970. But
the law does allow you to request
a reinvestigation of information in your
file that you dispute as inaccurate or
incomplete. Therefore, be sure and
verbalize the following statement to
each client:
“ It is important that you (the client)
understand the basis of the
credit services we represent. For any
result to be achieved as a result of
our company’s services, the credit
information to be processed needs to be
inaccurate, erroneous, or obsolete. Under these
circumstances, the information
must be deleted or modified by
the credit reporting agencies in
accordance with
the Fair Credit Reporting Act (FCRA).
Anyone that states otherwise is
mis-representing state and federal
laws.”
What this last part means is that a lot of
stuff will be taken off that actually
belongs to you but
we do not guarantee that those things will be
removed. ..It just ‘happens’.….
Another item of importance is to re-mind the client if they
only have bad items on their report and
most or all of it gets removed; it then
appears that the client has no credit at
all. But, this is not a bad place to be.
It is easier to re-build their credit
profile from this point than from
several negative items. We will provide
the client with information as part of
the counseling process that will aid him
in rebuilding their credit profile.

against more than 300 regulations of the
FAIR CREDIT REPORTING ACT.
These rules and regulations define how
credit bureaus are to enter items on the
consumer’s report. If ALL of the
more than 300 rules and regulations are
not followed, the item must be removed
according to the FAIR CREDIT REPORT
ACT and the FEDERAL TRADE
COMMISSION.
REMEBER:

does not deal with the legitimacy of the debt, but with the manner in
which the item was entered on a
consumer’s credit report.

were established

Reporting Act. After the act was passed,
no one was checking the credit
bureaus’ compliance with the act.

analogy to understand the process is as
follows-----
Suppose
you drove your car from point “A” to
point “B”. If we examine the DMV
rules and regulations, page by page
point “A” to point “B”, did you do
everything by the book?

states, the book says that before you
drive your car, you are supposed to walk
around your car and check the tires.
When you
enter the car, you are supposed to lock
the doors,fasten your seat belt, adjust
the side view mirrors, and adjust the
rear view mirrors. When you are ready to
proceed, you are supposed to look over
your shoulder, and hit your turn signal.
As you drive, you may never exceed the
posted speed limit. Did you follow every
single one of these rules? I doubt it!
Did you get a ticket? Doubt it! But you
did get from point “A” to point “B”.

point is that you drove from point “A”
to point “B”,
while probably violating a bunch of laws and getting away with it. This
is just like the credit reporting
agencies that have been driving
derogatory items from point “A” (the
creditors) to point “B” (the credit
report), while violating a whole bunch
of laws and getting away with it. NuLife
